Terms of Service
Draft: not yet in effect. Highlighted items are still being filled in. Questions: support@pennywink.com.
Last updated: not yet in effect (draft)
1. The agreement and who can join
These Terms are an agreement between you and PennyWink LLC, a Wyoming company ("PennyWink," "we," "us"). They cover PennyWink dating at pennywink.com, PennyWink Local Groups at pennygroups.com, and our apps (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
To use PennyWink you must:
- be at least 18 years old;
- be a real person using your own name, photos and government ID;
- have only one account (each ID can be used for one account only);
- not be barred from using the Service under U.S. law; and
- not have been removed from PennyWink before, unless we invite you back in writing.
You are responsible for keeping your password private and for everything done with your account. Tell us right away at support@pennywink.com if you think someone else has used it.
2. Identity verification, no background checks, and your safety
How we check that members are real. Before you can contact anyone, you must photograph your driver's license or state ID and take a live selfie on the secure page of our verification provider, Stripe. Stripe checks that the ID looks genuine, that you are 18 or older, and that your selfie matches the photo on the ID. Each ID may be used for only one account. If we remove someone for scams or abuse, that ID can't be used to join again.
We do our best to keep PennyWink real, but no check is perfect. A "Verified" badge means the person passed the ID and selfie check when they joined. It doesn't mean we know their history or their intentions, and it is not an endorsement.
PENNYWINK DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS OR SEX OFFENDER REGISTRY CHECKS ON ITS MEMBERS.
You are responsible for your own safety. Use good judgment in every conversation and meeting:
- There is no substitute for acting with caution when communicating with any stranger who wants to meet you.
- Don't share your last name, home address, phone number, workplace or financial information until you know someone well.
- Never send money or gift cards to anyone you met on PennyWink, for any reason.
- Before meeting, you can look up a person's full name for free at nsopw.gov, the U.S. Department of Justice's national sex offender search.
- Meet in a public place, tell a friend where you're going, arrange your own transportation, and leave if anything feels wrong.
- Report anyone who pressures you, asks for money, or seems to be someone other than who they say.
More tips are on our Safety tips page. We are not responsible for what members do on or off the Service.
3. Prices, renewals and refunds
Browsing is free. Prices are in U.S. dollars and are shown before you pay. Payments are handled by Stripe; we never see your full card number.

Contacts. Using one contact connects you with one member, after which you can both message each other. Winks and favorites are free. Contacts don't expire while your account is open.
Automatic renewal. Your dating membership renews automatically every year on the date you joined, at the price shown above, charged to the card on file, until you turn renewal off. We'll email you before each renewal. You can turn renewal off anytime under My contacts & membership → Manage membership; your membership then runs to the end of the year you paid for.
Local Groups pass. The pass covers every group, starting your own group, and reopening a closed one. It does not renew automatically; we'll remind you, and you choose whether to renew. Event cover charges, if any, are paid to the venue or organizer at the event, not to PennyWink.
Refunds. All purchases are final and non-refundable, except where the law requires a refund. Unused contacts and the unused part of a membership or pass are not refunded if you leave or are removed for breaking these Terms. If we close the Service for good, we'll refund the unused part of any membership or pass.
Price changes. We may change prices for future purchases and renewals. We'll tell you at least 30 days before a renewal at a new price, so you can turn renewal off first.
4. Rules for members
Be kind. If you don't like someone, block them and move on. You agree not to:
- harass, threaten, stalk, bully or intimidate anyone, on or off the Service;
- pretend to be someone else, use someone else's photos or ID, or misstate your age;
- ask anyone for money, gifts, gift cards, crypto or financial details, or run any scam;
- sell or promote anything, including OnlyFans or other paid content, escort or "sugar" arrangements;
- post links, phone numbers, email addresses or social media handles in profiles or first messages (our system blocks these to stop spam and scams);
- post nudity, sexual content, hate speech, threats, or anything illegal;
- post photos of anyone under 18, or of other people without their permission;
- use the Service if you are under 18, or try to contact anyone under 18;
- copy, scrape or collect other members' information, or use bots or automated tools;
- try to get around a block, a ban, or our security.
Reporting. Use the 🚩 Report button on any profile, message, group or event, or email support@pennywink.com. When you report a conversation, we keep a copy for 90 days so our safety team can review it.
What we may do. We may remove content, limit features, suspend or permanently remove any account that breaks these Terms or puts others at risk, with or without notice. When we remove an account for good, its verified ID is banned from joining again, and unused contacts, membership and pass time are forfeited. We may report illegal activity to the police. If you think we made a mistake, you can ask for a review through the Appeal page; a person on our team will look at it.
5. Local Groups and in-person events
Groups and events are created by members, not by PennyWink. We don't plan, host, supervise, inspect or insure any event or venue, and we aren't responsible for what happens at one. You attend at your own risk.
If you organize a group, you agree to:
- describe the group and each event honestly, including any cover charge (up to $25, paid at the event);
- choose public venues and follow the venue's rules and the law;
- follow the group rules shown when you start a group;
- not use a group to sell products or services, recruit for a business, or collect money beyond the stated cover charge.
A group stays open as long as its organizer posts an event at least every 4 months. Only members of a group can see who belongs to it, who's going to its events, and its discussion. Organizers can approve or remove members of their group. We may remove any group or event that breaks these Terms.
6. Your content and our content
Your content stays yours. You own the photos, profile text, messages and posts you add. You give PennyWink a non-exclusive, royalty-free, worldwide license to store, display and send that content only as needed to run the Service (for example, showing your profile to other members). This license ends when you delete the content or your account, except for copies we must keep under our Privacy Policy, such as reported conversations.
You promise that you have the right to post what you post, and that it follows these Terms. Don't post anything you wouldn't want other members to see; members can take screenshots, and we can't stop that.
Our content. The PennyWink and PennyGroups names, logos and website are ours. You may not copy or use them without our written permission.
Copyright complaints. If you believe something on the Service copies your work, email our copyright agent at [COPYRIGHT AGENT NAME], support@pennywink.com, [MAILING ADDRESS], with: your contact details; the work you say was copied; where it appears on PennyWink; a statement that you believe in good faith the use isn't authorized; and a statement, under penalty of perjury, that your notice is accurate and you own the work or may act for its owner, with your signature. We remove infringing content and close the accounts of repeat infringers.
Privacy. How we collect and use your information is explained in our Privacy Policy, which is part of these Terms.
7. Disclaimers and limits on our responsibility
The Service is provided "as is" and "as available." To the fullest extent the law allows, we make no promises about the Service, including that it will be error-free or always available, that you'll find a match, or that any member is who they say they are. We don't check members' criminal history, and we don't control what members say or do.
Release. You are solely responsible for your dealings with other members, online and in person. To the fullest extent the law allows, you release PennyWink and its owners, staff and contractors from claims arising from your dealings with other members or from any group or event. If you are a California resident, you waive California Civil Code section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
Limit of liability. To the fullest extent the law allows, PennyWink is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim is limited to the greater of what you paid us in the 12 months before the claim, or $50. Some states don't allow some of these limits, so they may not all apply to you.
Indemnity. If your content or your breaking these Terms or the law leads to a claim against PennyWink, you agree to cover our reasonable costs of that claim, including attorney's fees.
8. Disputes, changes and contact
Talk to us first. If you have a problem with PennyWink, email support@pennywink.com and give us 30 days to try to fix it before starting any legal claim.
Governing law and courts. These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Any claim must be brought in the state or federal courts located in [COUNTY], Wyoming, except that either of us may bring an individual claim in small claims court. Claims must be brought individually, not as part of a class action, to the extent the law allows.
Leaving. You can delete your account at any time under Settings → Delete account. Deleting it doesn't refund purchases (see section 3). Sections 3, 6, 7 and 8 continue to apply after your account ends.
Changes to these Terms. We may update these Terms. If a change is significant, we'll tell you by email or on the site at least 30 days before it takes effect. Using the Service after that date means you accept the new Terms.
Other. If any part of these Terms can't be enforced, the rest still applies. If we don't enforce a part right away, we haven't given it up. You may not transfer your account or these Terms to anyone else.
